California judge overturns Proposition 8

SAN FRANCISCO — A California judge has overturned the voter referendum that bans same-sex marriage in California.
In a ruling issued Wednesday afternoon, Chief U.S. District Judge Vaughn Walker struck down Proposition 8, passed by 7 million voters in 2008. Prop 8 had been challenged by two same-sex couples and the city of San Francisco in Perry et al vs. Schwarzenegger. Prior to the judge's ruling, which was released shortly before 2 p.m. Pacific Time, both sides had said they will appeal to the 9th Circuit Court of Appeals, the last step before the U.S. Supreme Court.
Tuesday night, lawyers for the Prop 8 defense team petitioned the judge, asking that should he decide for the plaintiffs, that he stay his decision pending an immediate appeal so that no same-sex marriages can be performed until the appeals process is completed.
